General sales conditions

for the product scenic flights

A. Object 

These general conditions govern the relationship between Heli Guides S.r.l.  (“Seller”) and the customer”) Buyer”), with particular reference to online sales through the website  (“Website”), of the products displayed therein (“Products” or “Product”).

These Terms are the Conditions of Carriage referred to on the boarding pass that will be sent by the Seller at the confirmation of the Order.

B. Product and price

The features of the Products are specified on the Website, in their respective descriptions.

The Product will be purchased via the e-commerce channel and paid at the time of booking at the indicated price, expressed in Euro.

The payment may be performed with the accepted credit cards (Visa, Mastercard, Postcard) or through PayPal and the billing will be automatically addressed by Heli Guides S.r.l. to the Buyer.

C. Conclusion of the sales contract 

By confirming the order placed in the shipping cart displayed on the Website (“Order”) and declaring to have read, understood, and accepted these Terms, the Buyer submits a binding purchase proposal.

The sales contract (“Contract”) will be concluded with the submission of the order confirmation by the Seller to the e-mail address indicated by the Buyer (“Confirmation”).

D.  Buyer’s request for change or cancellation.

The Buyer may request, within 24 months of the online purchase and without surcharge, the change of the date of the flight in compatibility with the availability and organizational needs of the Seller, or the cancellation of the same, with reimbursement of the price paid.

The booking date will remain, in any case, that of the first booking.

The request for modification or cancellation must reach the Seller at least 24 hours before the scheduled take-off (48 hours before in case of purchase of a single passenger seat). No changes or refunds will be recognized in case of no-show at boarding.

In case of the purchase of a voucher, this will be valid for 24 months from the date of issue.

E. Modification or cancellation by the Seller.

The Seller reserves the right to cancel the flight in case of expected or certain adverse weather conditions that prevent or make the take-off and carrying out of the activity dangerous. In these circumstances, the Buyer will be proposed a change of date for the flight, or the refund of the price paid.
The Seller will not, in any case, be held liable for damages or expenses resulting from the cancellation of the flight or its change of date.
In addition, in case of sale of a single passenger seat, the Seller reserves the right to cancel the departure, unless otherwise specified, if the minimum number of participants, set at 5, has not been reached. Such cancellation may take place within 24 hours before the scheduled flight departure time. In this circumstance, the Seller will propose the Buyer to change the date of the flight or to be refunded of the paid price.
The Seller will not, in any case, be held liable for damages or expenses resulting from the cancellation of the flight or from the change of the date scheduled for the same.

F. Boarding Pass – Boarding

The boarding pass, printable, will be sent by the Seller at the confirmation of the Order.

The passenger is obliged to arrive at the embark location 15 minutes before the scheduled flight time, in possession of the boarding pass and of a valid identity document, otherwise, he/she cannot be admitted on board the helicopter and will not be entitled to any refund.

The Seller will not be held liable for damages or expenses resulting from the Buyer’s failure to comply with these provisions.

The Seller may also refuse to board the passenger:

  • whether his/her behavior, state or mental or physical condition, including the effects of alcohol or drugs, could endanger him/herself, other passengers or crew members;
  • if the passenger behaved in an unacceptable way on a previous flight and there is reason to believe that such behavior may occur again;
  • if the passenger exhibits a ticket acquired or received unduly or in violation of the Terms of Participation or that is counterfeit;
  • if the passenger does not comply with the Seller’s safety regulations.

The Seller reserves, in any case, the right to check whether the passenger’s transport may involve risks to the safety or health of other passengers and, in this case, may refuse boarding and the provision of the service.

In all the cases mentioned above, the right to any refund is excluded.

G. Special assistance

The transport of disabled or ill passengers or passengers requiring special assistance must be reported in advance. The transport may be refused if the buyer has not communicated any special need at the time of booking.

H. Transport of children

Children who have not yet reached the age of 16 may travel only if accompanied by an adult who is at least 18 years of age and has a valid delegation from the child’s parents or from a person having parental authority.

I. Baggage

Passenger bags must not contain items that could endanger the aircraft, persons or on-board property (explosives, compressed gases, carbonated beverages, oxidizing, radioactive or magnetic materials, highly flammable materials and poisonous or aggressive substances), as well as dangerous items, unsafe or inadequate for transport due to their weight, size or type.

L. Photos and videos on board

It is only allowed to take photos and make movies on-board if it is possible to protect and guarantee the rights of the photographed people, in particular their right to privacy.

M. Covid-19

In view of the current pandemic situation, the health protocols of the helicopter companies with which the Seller collaborates require the sanitization of the aircraft before each embarkation, as well as for passengers the obligation to:

  • sanitize the hands, with a sanitizing gel made available by the organization before boarding the aircraft;
  • wear a surgical mask covering entirely the mouth and nose during boarding, for the duration of the flight and when leaving the aircraft. Children up to the age of six and persons who are clearly unable to wear a mask for health reasons shall be exempted from this obligation upon presentation of a valid medical certificate;
  • undergo the measurement of body temperature before boarding, with a prohibition to board if the temperature exceeds 37.5 degrees.

N. Prohibition of the use of products

Travel tickets are non-transferable. Any commercial use of the Products by the Buyer, in particular for the purpose of resale to third parties, is expressly prohibited.

The ticket is and always remains the property of the Seller and demonstrates the existence of a transportation contract between the Seller and the Buyer.

O. Data protection

The Seller confirms to fully respects the data protection legislation, specifying to only process the data to the extent necessary for the correct execution of the Contract in accordance with the Privacy Policy 2016/679.

P. Intellectual property

Trademarks, domain names, copyrights as well as any other intellectual or industrial property rights on the Website and/or relating to the Products on the site are the exclusive property of the Seller and are protected by the current applicable legislation. Therefore, any use without the prior written consent of the Seller is absolutely prohibited.

Q. Competent Court

For each dispute, the Seller and the Buyer declare to elect the executive and judicial court of Aosta.

We expressly recall all the Conditions of Carriage specified in the General Conditions of Sale for the product panoramic flights on that the Buyer, with the purchase proposition, has stated to have read, understood, and accepted.
